Notarial Central Registers

The Notarial Central Registers are public registers maintained by the Central Information System of the Chamber of Notaries of the Slovak Republic and kept in electronic form. Every notary has access to the Central Information System and, where provided for by special legislation, other persons also have access. The Central Information System consists of a central component located directly at the Chamber of Notaries of the Slovak Republic and client components administered by the notary concerned. However, the entire system is the exclusive property of, and is administered by, the Chamber of Notaries.

Notarial Central Register of Designated Legal Entities

The Notarial Central Register of Designated Legal Entities is a public register. The notary’s role is to register designated legal entities in it as recipients of 2% of income tax under the Income Tax Act. Subject to fulfilling the applicable conditions, a natural person or legal entity may allocate a share of the tax paid, amounting to 1%, 2% or 3%, to selected recipients (such as non-profit organisations and civic associations) included in the public register. The Chamber of Notaries of the Slovak Republic publishes the list of recipients of a share of the tax on its website every year in the second half of January.

Central Register of Wills

The Notarial Central Register of Wills contains registered wills, instruments of disinheritance and revocation, and other legal acts connected with inheritance proceedings. In inheritance matters, a notary acts under the authority of the court as a court commissioner and, where the prescribed conditions are met, may conclude the inheritance proceedings within the notary’s own competence by issuing a certificate of inheritance. The Central Register of Wills is kept in electronic form and also contains records of wills that have not been declared, which may be registered electronically through secure communication within the system, between the client component at the notary’s office and the server at the Chamber.

Central Register of Security Interests

The Central Register of Security Interests registers security interests over movable property, claims, businesses or parts thereof. The Chamber of Notaries maintains this register, which records the date and time of registration of a security interest, identifying details and all relevant particulars. Details of the register are governed by Decree No. 607/02 Coll. of the Ministry of Justice of the Slovak Republic, laying down details of the Notarial Central Register of Security Interests. The Notarial Central Register of Security Interests is a public register published on the Chamber of Notaries’ website. A security interest may be created on the basis of a contract, by law or by a court decision, or, as the case may be, a certificate of inheritance, pursuant to the provisions of the Civil Code. The notary registers the security interest in the Central Register of Security Interests and, upon request, issues an extract or confirmation that no particular registration appears in the Register of Security Interests.

Central Register of Documents

The Chamber of Notaries maintains the Central Register of Documents, which contains court documents, notarial deeds drawn up by notaries and other documents deposited in the Register of Documents. The electronic Central Register of Documents enables members of the public to register documents at one notary’s office and obtain a certified copy of a document at any later time from another notary’s office. Natural persons may register documents in the Central Register with the assistance of a notary at a notary’s office by bringing the original document and requesting that it be registered in the electronic archive.
